1. Acceptance of Terms
Welcome to PrepMethod (“we”, “us”, or “our”). PrepMethod is operated by YS Infomatics Pty Ltd(ABN 46 644 607 714), an Australian company. These Terms of Service (“Terms”) govern your access to and use of our website located at www.prepmethod.com.au(the “Site”) and the services, features, and content provided through the Site (collectively, the “Service”).
By creating an account, making a purchase, or otherwise using the Service, you (“you” or “your”) agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of a child under 18, you represent that you are the parent or legal guardian of that child and agree to these Terms on the child's behalf.
Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded by agreement.
2. Accounts and Registration
2.1 Eligibility
You must be at least 18 years of age to create an account, purchase a subscription, or buy credits. Users under the age of 18 (“Students” or “Minors”) may only use the Service under a household account created and supervised by a parent or legal guardian (“Parent”).
2.2 Household Model
When a Parent signs up, a household is created. The Parent may add one or more Student accounts to the household. Each Student receives their own login credentials (email-based or PIN-based, as selected by the Parent). The Parent is responsible for all activity within their household and for ensuring each Student's use complies with these Terms.
2.3 Account Security
You are responsible for safeguarding your password, PIN, and any other credentials associated with your account. You agree to notify us immediately at support@prepmethod.com.au of any unauthorised use. We are not liable for any loss arising from your failure to protect your account credentials.
2.4 Accurate Information
You agree to provide accurate, current, and complete information during registration and to keep it up to date.
3. Subscriptions, Credits, Payments and Cancellations
3.1 Subscription Plans
We offer tiered subscription plans (e.g. Starter, Premium) with different features and limits. Plan details and pricing are displayed on our Pricing page and are fetched in real time from our payment provider. All prices are in Australian dollars (AUD) and are inclusive of GST where applicable.
3.2 Free Trial
We may offer a free trial on certain plans. A free trial is limited to one per household and may not be restarted once used. We reserve the right to modify or discontinue free trials at any time.
3.3 Credits
Certain features (e.g. mock exams, AI-generated reports) consume credits. Credits are purchased separately and are non-refundable once used. Unused credits remain in your household wallet indefinitely, unless your account is terminated.
3.4 Billing and Renewal
Paid subscriptions are billed in advance on a recurring monthly or annual basis. All payments are processed by our third-party payment processor, Stripe. By providing payment information, you authorise us and Stripe to charge your nominated payment method. Subscriptions automatically renew unless cancelled before the renewal date.
3.5 Cancellation
You may cancel your subscription at any time from the Billing page in your account. Cancellation takes effect at the end of the current billing cycle — you retain access to paid features until that date. No further charges will be made after cancellation.
3.6 Refund Policy
Subscription payments are generally non-refundable. However, your rights under the Australian Consumer Law are not affected — if the Service has a major failure, you are entitled to a refund. For refund enquiries, contact support@prepmethod.com.au.
3.7 Price Changes
We may change subscription prices with at least 30 days' prior notice (via email to your registered address). Your continued use after the new pricing takes effect constitutes acceptance of the updated prices.
4. Use of the Service
4.1 Licence
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial educational purposes within your household.
4.2 Acceptable Use
You agree not to:
- Share individual account credentials with anyone outside your household.
- Resell, sublicence, or redistribute access to the Service.
- Use automated scripts, bots, or scrapers to access or collect data from the Service.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Use the Service for any unlawful, fraudulent, or harmful purpose.
- Interfere with or disrupt the integrity or performance of the Service.
5. Intellectual Property
5.1 Our Content
All content provided through the Service — including text, graphics, logos, question content, software, and AI-generated materials (“Service Content”) — is the property of YS Infomatics Pty Ltd or its licensors and is protected by Australian and international intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service or Service Content without our express written consent.
5.2 AI-Generated Content
The Service uses artificial intelligence to generate educational content, including practice questions, explanations, and progress reports. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. Service Content is provided for practice purposes only and does not guarantee success on any exam.
6. Termination
We may suspend or terminate your account at our discretion, with or without notice, for conduct that we reasonably believe violates these Terms, is harmful to other users, or for any other lawful reason. Upon termination, your right to access the Service ceases immediately. Any credits remaining in your wallet at the time of termination for cause are forfeited.
You may close your account at any time by contacting support@prepmethod.com.au. If you have an active subscription, cancellation of the subscription should be completed first via the Billing page.
7. Disclaimers and Limitation of Liability
7.1 Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
7.2 Limitation of Liability
To the fullest extent permitted by Australian law, YS Infomatics Pty Ltd, its directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from your use of or inability to use the Service.
Our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service will not exceed the total amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim, or AUD $100, whichever is greater.
7.3 Australian Consumer Law
Certain legislation, including the Australian Consumer Law, may imply warranties or conditions or impose obligations that cannot be excluded. Nothing in these Terms purports to exclude, restrict, or modify any such non-excludable right or remedy. To the extent permitted by law, our liability for breach of any non-excludable consumer guarantee is limited to re-supplying the relevant service or paying the cost of having the service re-supplied.
8. Indemnification
You agree to indemnify and hold harmless YS Infomatics Pty Ltd, its directors, employees, and affiliates from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms, your use of the Service, or any violation of applicable law.
9. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on the Site at least 14 days before the changes take effect. Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the changes. If you do not agree, you should stop using the Service and cancel your subscription.
10. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia for any dispute arising out of or in connection with these Terms or the Service.
Before commencing formal proceedings, both parties agree to attempt to resolve any dispute in good faith through informal negotiation for at least 30 days.
11. General
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
- Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights to an affiliate or successor in interest.
